Some Attendance Restrictions Apply

If you wish to take your Texas defensive driving course online for traffic ticket dismissal, you should read the following requirements.

  • Either on or before the date assigned to you on your notice to appear, you must enter a plea of guilty or no contest in response to the charge against you.
  • The State of Texas stipulates that you must not have completed an approved driver safety course within 12 months prior to the date of your current offense.
  • You must provide proof of insurance, also known as evidence of financial responsibility.
  • You must possess a valid Texas Driver's License.
  • Drivers who have been charged with any of the following offenses may not attend: speeding (in excess of 25 mph over the posted limit); speeding in a school zone or work zone; or a Texas seat belt violation.

Note: If you have committed a Texas seat belt violation, you can take the online seat belt course with Texas Drive Safe.

If you are not sure whether you can attend this course, we recommend that you contact the court. Texas courts have the authority to allow a driver to attend a defensive driving course for ticket dismissal in the majority of situations.

Obtaining Permission from a Texas Court

You can request permission from a Texas Court to go to defensive driving school for your Texas speeding ticket or other infraction. Just follow these steps after you receive your citation.

  • In Person Request – If you appear in court in person or by counsel on or before your due date (as shown on your ticket), you can make an in-person request for defensive driving course attendance. Once it has been determined that you are eligible and you have entered a plea of guilty or no contest, the judge will notify you of your requirement to complete a TEA approved defensive driving course and report your completion to the court.
  • Written Request for Permission – You are also permitted to make your request in writing. This is a useful option for out of state drivers who have received a Texas ticket. Fill out the required information on the back of the ticket and send it in to the court. You can then enter your guilty or no contest plea and request that you be allowed to take a State-approved defensive driving course for ticket dismissal.
  • Telephone Request – Some Texas courts will also allow an individual to call in and request permission to attend the ticket dismissal course.
